Club 8 Terms and Conditions

These Terms and Conditions (“Terms”) form a legally binding agreement between Club 8 Limited (NZBN 9429051234567), a company registered in New Zealand (“Club 8”, “we”, “us”, or “our”) and you (“you” or “your”).

They govern your use of the Club 8 website (www.club8nz.com), mobile applications, membership, event participation, merchandise purchases, and any other services or content we provide.

By accessing the website, registering an account, purchasing a membership, attending an event, or using our services, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree, you must immediately stop using our services.

Your electronic acceptance is recorded and constitutes a binding signature.

These Terms are governed by the laws of New Zealand. Any dispute will be resolved exclusively in New Zealand courts.

1. INTRODUCTION & ACCEPTANCE

* These Terms apply to all interactions with Club 8, including website use, membership, event attendance, merchandise purchases, and participation in Club 8 Gaming (skill-based online tournaments) or Events (in-person automotive, venue, or community gatherings).

* You must be at least 18 years old and legally capable of entering contracts. By using our services, you confirm you meet these requirements.

* Continued use after any amendment to these Terms means you accept the changes.

2. GENERAL CONDITIONS OF PARTICIPATION

* You must obey all New Zealand laws. We may refuse service or terminate access for any breach.

* All activities are voluntary. You assume all risks, including technical issues, travel, and third-party interactions.

* You must uphold Club 8 values: growth, discipline, presentation. Disruptive or illegal behaviour may result in immediate removal and permanent ban.

3. CLUB 8 GAMING (SKILL-BASED CHALLENGES)

* Club 8 Gaming is not gambling. Outcomes are based solely on skill (e.g., score, position, kills).

* Access: Gold members - Free-For-All (FFA) challenges; Diamond > Executive > Arkhon members - 5-v-5 and higher-tier challenges. No entry fees required.

* You are responsible for your connection and equipment. Lag or disconnections count as a loss.

* Cheating, exploiting, or account sharing results in immediate permanent ban, prize forfeiture, and non-refundable membership termination.

* We may suspend payouts during investigations. Confirmed misconduct allows civil recovery under NZ law.

* Up to two staff may compete to defend prizes. Staff wins are donated to OUR IMPACT.

* Participation grants consent to be recorded for disputes, marketing, or training.

* We are not liable for platform failures or third-party issues.

4. MOTOR SCENE / AUTOMOTIVE EVENTS

* Attendance and driving are voluntary. You are responsible for your safety, vehicle compliance, and road rules.

* We are not liable for accidents, vehicle damage, injury, death, or third-party actions.

5. NIGHT SCENE / VENUE EVENTS (VIP EXPERIENCES)

* Free entry, drinks, or seating are discretionary and subject to venue availability.

* You must follow venue terms. We are not liable for denied entry, intoxication, injury, or damage.

* You must be 18+ depending on venue and Night Event. ID may be required. We are not liable for refusal of alcohol service.

6. BRAND, MEDIA & INTELLECTUAL PROPERTY

* "Club 8" and all designs are owned by The Architect (Bowen) and licensed to Club 8 Limited.

* Unauthorised use may lead to legal action.

* Attendance grants us a worldwide, royalty-free licence to use your image, name, and voice for promotion.

7. STAFF, VOLUNTEERS & CONTRIBUTORS

* Unless contracted in writing, all contributions are donations. No employment or ownership rights are created.

8. MEMBERSHIP TERMS

* Membership Tiers (Summary - Non-Binding):

- Gold ($8.80nzd/week): FFA Gaming, Event Access, Media (if captured)

- Diamond ($12.80/week): 5-v-5 Gaming, Priority Events, Photography, Videography

- Executive ($22.80/weed) All above + Free Merch Drop every 3 months

- Arkhon ($44.80/week): All above + Guest, Hosting, Free Monthly Merch

* Membership does not grant ownership, shares, voting rights, or legal stake in Club 8 or its operations.

* Membership fees are non-refundable under any circumstances except where required by applicable consumer law, such as if Club 8 fails to provide the agreed services.

* When you purchase a membership, you are paying to be recognised within the Club 8 community at your chosen tier. This is not a product, ticket, or entitlement to specific access or rewards unless explicitly stated. It is not a way to purchase entry into events, challenges, or spaces, nor is it a method to generate income or financial return. You are joining as a member – not buying a service. Access to perks such as Club 8 Gaming, in-person events or any other Event hosted by Club 8 may be included with membership, but these are privileges granted to members, not guaranteed rights. All access is subject to Club 8's discretion and may be changed, limited, or revoked on reasonable grounds with reasonable notice (except in cases of breach or safety).

* We reserve the right to revoke membership at any time for breach of these Terms or conduct contrary to our values.

* Members are expected to represent the Club's standards: growth, discipline, presentation, and contribution.

* Members attending Club events must wear black, be well-groomed, and present themselves with pride. Entry may be denied for failure to meet Club standards.

* By purchasing a Club 8 membership, you agree to a minimum commitment period of 90 days. If you choose to cancel your membership within this 90-day period for any reason, a $50 early cancellation fee will be charged to your saved payment method. This fee is a genuine pre-estimate of administrative and onboarding costs and will not exceed actual loss. The cancellation fee is non-refundable and applies regardless of how much or how little you used your membership during that time.

* Membership does not guarantee photos or video coverage during events. Media is only provided if captured successfully by Club staff.

* Arkhon members may bring one guest to private Club 8 events. This guest must be their partner (boyfriend or girlfriend husband/wife) no relatives or friends permitted.

* Arkhons may be offered opportunities to host events on behalf of Club 8, provided these events meet the brand's standards and guidelines. Any potential profit share or payment arrangement will be agreed upon in writing before the event takes place. These opportunities do not constitute guaranteed income or profit and are provided solely at Club 8's discretion.

* Arkhon members will receive monthly merchandise deliveries to their nominated address. This may include both exclusive Arkhon merchandise and general Club 8 merchandise. Completely random. Delivery times and specific items may vary and are subject to availability. No guarantees on quantity of items or value.

* Executive members will receive monthly merchandise deliveries to their nominated address. This may include both exclusive Executive merchandise and general Club 8 merchandise. Completely random. Delivery times and specific items may vary and are subject to availability. No guarantees on quantity of items or value.

* By entering any Club 8 event or participating in Club 8 Gaming, you acknowledge that Club 8 Limited reserves the right to investigate any suspicious activity and, where misconduct is confirmed, pursue the individual to the fullest extent permitted under New Zealand law – including but not limited to civil recovery of funds, event bans, and permanent account restrictions.

* If a member purchases a Club 8 membership, and then cancels or removes their membership, they will be subject to a 30-day waiting period before any perks or benefits can be reinstated upon rejoining. This policy is in place to protect the value of Club 8 and ensure fair access for all active, committed members. No exceptions will be made unless approved by Club 8 management.

* Membership fees are charged on a weekly recurring basis, automatically billed to your chosen payment method each week until you cancel.

* By subscribing to a membership, you authorise Club 8 to charge these weekly payments and understand that cancellation requests must be made prior to the next billing cycle to avoid further charges. Cancellation can be made on your profile under (subscriptions) (top left on the home page (club8nz.com)).

* Nothing in these Terms excludes or limits any rights you have under the Consumer Guarantees Act 1993 where the services are supplied to you as a "consumer". If you acquire services for business purposes, the parties agree the CGA does not apply to the extent permitted by section 43.

9. MERCHANDISE & SALES

* All merchandise sales are final unless the product is faulty or damaged due to our error.

* No refunds for incorrect sizing, change of mind, or misuse of products.

* Fulfilment timelines may vary based on supplier or delivery delays. We are not responsible for courier services or third-party vendors.

10. DATA PRIVACY

* We collect and store personal information (e.g. names, emails, address, payment details) via Wix, which complies with New Zealand's Privacy Act 2020.

* By using our site or becoming a member, you consent to this collection and storage.

* Your information will never be sold or misused. You have the right to request access, correction, or deletion of your personal data at any time by emailing admin@club8nz.com.

11. COMMUNITY ASSISTANCE & OUR IMPACT

* Club 8 is not a charity and does not claim to be one.

* Assistance and donations come from Club funds, members, and investor support, always for community impact, not personal gain.

* We assess all community aid recipients. Individuals suffering from self-sabotage, gambling, or addiction are considered on a case-by-case basis.

* Membership funds are used at Club 8’s sole discretion to cover operational costs, events, prizes, community initiatives, and business expenses. **There is no fixed percentage allocated to OUR IMPACT.** Funds are distributed strictly on a case-by-case basis: who needs help, what resources we have, and what the Club requires. No member has any claim to specific allocation or financial reporting.

* OUR IMPACT operates transparently but informally. We share receipts, photos, letters, and updates where possible (e.g., Discord, website). No formal audits or tracking exist aid is delivered directly to verified needs at Club 8’s discretion.

12. LEGAL COMPLIANCE & MISCONDUCT

* Club 8 is not a gang and does not affiliate with gangs or criminal groups.

* Suspected money laundering or fraudulent financial activity will be reported directly to the New Zealand Police and fraud agencies.

* Anyone attempting to use Club 8 for illegal purposes will be removed and fully reported.

* Any official cryptocurrency project by Club 8 will be announced only on www.club8nz.com. Any coin or token claiming affiliation without such announcement is unauthorised. We do not engage in rug-pulls, pump-and-dump tactics, or deceptive crypto practices. Any impersonation or misuse of Club 8's name in the crypto space will be pursued legally.

13. OTHER CLUBS AND BRANDS DIRECTORY

* Club 8 Limited maintains a directory titled “Other Clubs and Brands” (or similar), as a public information resource listing car clubs, motorcycle clubs, enthusiast groups, and automotive-related brands that are known to be active in Australia and/or New Zealand within the Motor Scene Community.

* Inclusion in the directory does not constitute any endorsement, recommendation, approval, certification, sponsorship, or affiliation by Club 8 Limited or any of its officers, employees, or related entities.

* The absence of the “Club 8 Verified” badge from any listing simply indicates that the relevant entity has not yet applied for, or has not completed, Club 8 Limited’s voluntary verification and collaboration process. It is not a statement (express or implied) about the quality, reputation, safety, legitimacy, reliability, performance, or any other attribute of the listed club or brand.

* All information in the directory is sourced from publicly available material or voluntary submissions. Club 8 Limited does not verify the accuracy or currency of third-party information and makes no representations or warranties of any kind in relation to it.

* Any use of third-party names, trademarks, logos, or other intellectual property in the directory is purely for identification and reference purposes and does not imply permission from the owner.

* To the fullest extent permitted by law, Club 8 Limited excludes all liability (whether arising in contract, tort including negligence, equity, under statute, or otherwise) for any loss, damage, cost, or expense suffered or incurred by any person in connection with the directory or reliance on its contents.

14. LIMITATION OF LIABILITY

Club 8 Limited is not liable for:

* Any personal injury, illness, death, property damage, or loss occurring before, during, or after events including but not limited to public road cruises, static meets, night events, and gatherings on public or private property

* Any accident, offence, or incident occurring on public roads or between event locations, whether involving you, another participant, or a third party

* Damage, injury, or loss caused to or by third parties as a result of your participation

* Loss of data or financial damage arising from use of the site or services

* Failures, errors, or disruptions caused by third-party providers, venues, or platforms outside Club 8's direct control

* Events beyond our reasonable control (force majeure) including pandemics, government restrictions, or venue closures

By attending or participating in any Club 8 Limited activity, you:

* Acknowledge that all activities are voluntary and carry inherent risks, including but not limited to traffic hazards, weather conditions, mechanical failure, actions of other road users, and actions of other event attendees

* Accept full personal responsibility for your safety, your passengers, your property, and your compliance with all New Zealand road laws and vehicle regulations

* Release, waive, and discharge Club 8 Limited, its directors, organisers, volunteers, and affiliates from any and all claims, demands, actions, or causes of action whether arising from negligence or otherwise to the fullest extent permitted by New Zealand law.

15. CHANGES TO TERMS

* We may revise these Terms at any time. Updates will be posted on our website, and we'll notify members via email or Discord if substantial changes are made.

* Continued use of our site or services after such updates means you accept the revised Terms.

* Disputes: Contact admin@club8nz.com. If unresolved within 14 days, either party may refer to the Disputes Tribunal or mediation.

* If any provision is held invalid or unenforceable, the remainder of these Terms remains in full force.
